MAZARA, DENISE, ANOTHER 90 DAYS FOR THE FILING OF THE REASONS FOR THE APPEAL VERDICT
(January 13, 2016) Denise Pipitone kidnapping. It will be necessary to wait another 90 days to learn the reasons for the verdict with which, last October 2, the third section of the Palermo Court of Appeal acquitted Jessica Pulizzi of the charge of complicity in the kidnapping of a minor. The news was announced today by Mrs. Piera Maggio. “I can still wait, what are all these years without knowing where my little girl is,” was the laconic comment written on Facebook by Denise’s mother, who disappeared in Mazara del Vallo on September 1, 2004. “Evidently,” added Piera Maggio, “eleven years spent without my daughter, without truth and justice, are not enough.” (Source: Televallo)

The third section of the Palermo Court of Appeal was unable to file the reasons for Jessica Pulizzi's acquittal within the required deadline (90 days). The judges have, in fact, requested another 90 days. Is there still some detail to be finalized?
Some aspects that cannot be explained? Who knows if one day we will find out… The confirmation, on appeal, of Jessica Pulizzi's acquittal from the charge of complicity in the kidnapping of her "stepsister" Denise Pipitone is dated October 2, 2015. More than eleven years after the disappearance of Denise in Mazara (it was September 1, 2004).
Meanwhile, for the lawyer from Mazara, Fabrizio Torre, who defended Jessica together with Gioacchino Sbacchi from Palermo, there is nothing unusual about the request for an extension by the judges of the second instance. “Given the extreme importance of the evidentiary hearing conducted on appeal,” says lawyer Torre, “I believe that this request for an extension of the deadline for filing the reasons falls within normal and physiological practice. Difficulties in justifying some aspect of the verdict? I don't think I can share this hypothesis. I would not attribute any particular meaning to the request, other than organizational needs of the Court, which needs to continue working on the reasons for the verdict. After all, it is an important proceeding.”
For Jessica, even the Attorney General Rosalba Scaduto had called for a 15-year prison sentence, as had already been done, in the first instance, by the prosecutors of Marsala. "There is no justice," commented Piera Maggio after Jessica's second acquittal, "and today we have had confirmation of that. I will continue to look for my daughter." Also heartbroken, last October 2, was Piero Pulizzi, Denise Pipitone's biological father and also Jessica's father. "It is a sad moment for Italian justice," declared the civil party lawyer Giacomo Frazzitta. "We are waiting for the reasons for the verdict. The case of Chiara Poggi comes to mind: even there, the defendant was acquitted twice. But then, the Supreme Court established different things."Source: A.P. 01/23/2016

The drafting of the reasons for the verdict with which, last October 2, the third section of the Palermo Court of Appeal (president Raimondo Lo Forti) confirmed the acquittal of Jessica Pulizzi from the charge of complicity in the kidnapping of her “stepsister” Denise Pipitone, who disappeared in Mazara on September 1, 2004, is evidently proving more complicated than expected. In fact, the Court of Appeal has requested another 90 days to write and file the reasons. “We are waiting,” is the terse comment, on Facebook, from lawyer Giacomo Frazzitta, civil party attorney assisting Piera Maggio, mother of the missing child. On the opposite side, meanwhile, one of Jessica’s two defense lawyers, Fabrizio Torre, rejects the hypothesis that the judges are having difficulty finding the right reasons for an acquittal that left a bitter taste for Piera Maggio and Piero Pulizzi. “Given the extreme importance of the evidentiary hearing held on appeal,” says lawyer Torre, “I believe that this request for an extension of the deadline for filing the reasons falls within normal and physiological practice. Difficulties in justifying some aspect of the verdict? I don’t think I can share this hypothesis. I would not attribute any particular meaning to the request, other than organizational needs of the Court, which needs to continue working on the reasons for the verdict. After all, it is an important proceeding.” For Jessica Pulizzi, even the Attorney General Rosalba Scaduto had called for a 15-year prison sentence, as had the prosecutors in Marsala at first instance. At first instance, Denise’s stepsister was acquitted by the Marsala Court “for not having committed the act,” although with the formula of the second paragraph of article 530 of the code of criminal procedure. During the appeal trial, a sensational environmental wiretap emerged, carried out 40 days after the kidnapping, in which, according to expert Mendolìa, Jessica Pulizzi is heard whispering to her younger sister Alice: “We were at home... mom killed Denise.” But another expert appointed by the same Court of Appeal (Delfino) later stated that the sensational phrase “is partly inaudible.” But even this wiretap (for the defense lawyers “nothing can be heard”) did not serve to overturn the verdict. MAZARA, DENISE, ANOTHER 90 DAYS FOR THE FILING OF THE REASONS FOR THE APPEAL JUDGMENT
(January 13, 2016) Denise Pipitone kidnapping. Another 90 days will have to pass before knowing the reasons for the sentence with which, last October 2, the third section of the Palermo Court of Appeal acquitted Jessica Pulizzi of the charge of complicity in the kidnapping of a minor. The news was announced today by Mrs. Piera Maggio. "I can still wait, what are all these years without knowing where my little girl is," was the laconic comment written on Facebook by Denise's mother, who disappeared in Mazara del Vallo on September 1, 2004. "Evidently," added Piera Maggio, "eleven years spent without my daughter, without truth and justice, are too few." (Source: Televallo)

The third section of the Palermo Court of Appeal was unable to file the reasons for Jessica Pulizzi's acquittal within the required deadline (90 days). The judges have, in fact, requested another 90 days. Is there still some detail to be finalized?
Some aspects that cannot be explained? Who knows if one day we will find out… The confirmation, on appeal, of Jessica Pulizzi's acquittal from the charge of complicity in the kidnapping of her "stepsister" Denise Pipitone is dated October 2, 2015. More than eleven years after Denise disappeared in Mazara (it was September 1, 2004).
Meanwhile, for the lawyer from Mazara, Fabrizio Torre, who defended Jessica together with Gioacchino Sbacchi from Palermo, there is nothing unusual in the request for an extension by the judges of the second instance. "Given the extreme importance of the evidentiary hearing conducted on appeal," says lawyer Torre, "I believe that this request for an extension of the deadline for filing the reasons falls within normal and physiological practice. Difficulties in justifying some aspect of the verdict? I don't think I can share this hypothesis. I would not attribute any particular meaning to the request, other than organizational needs of the Court, which needs to continue working on the reasons for the verdict. After all, this is an important proceeding."
For Jessica, even the Attorney General Rosalba Scaduto had called for a 15-year prison sentence, as had already been done, in the first instance, by the prosecutors of Marsala. "There is no justice," commented Piera Maggio after Jessica's second acquittal, "and today we have had confirmation of that. I will continue to look for my daughter." Also heartbroken, last October 2, was Piero Pulizzi, Denise Pipitone's biological father and also Jessica's father. "It is a sad moment for Italian justice," declared the civil party lawyer Giacomo Frazzitta. "We are waiting for the reasons for the verdict. The drafting of the reasons for the verdict with which, last October 2, the third section of the Palermo Court of Appeal (president Raimondo Lo Forti) confirmed the acquittal of Jessica Pulizzi from the charge of complicity in the kidnapping of her "stepsister" Denise Pipitone, who disappeared in Mazara on September 1, 2004, is evidently proving more complicated than expected. In fact, the Court of Appeal has requested another 90 days to write and file the reasons. "We are waiting" is the terse comment, on Facebook, of lawyer Giacomo Frazzitta, civil party attorney assisting Piera Maggio, mother of the missing girl. On the opposite side, meanwhile, one of Jessica's two defense lawyers, Fabrizio Torre, rejects the hypothesis that the judges are having difficulty finding the right reasons for an acquittal that left a bitter taste for Piera Maggio and Piero Pulizzi. "Given the extreme importance of the evidentiary hearing held on appeal," says lawyer Torre, "I believe that this request for an extension of the deadline for filing the reasons falls within normal and physiological practice. Difficulties in justifying some aspect of the verdict? I don't think I can share this hypothesis. I would not attribute any particular significance to the request, other than organizational needs of the Court, which needs to continue working on the reasons for the verdict. After all, this is an important proceeding." For Jessica Pulizzi, even the Attorney General Rosalba Scaduto had called for a 15-year prison sentence, as did the prosecutors in Marsala at first instance. At first instance, Denise's stepsister was acquitted by the Marsala Court "for not having committed the act," although with the formula of the second paragraph of article 530 of the code of criminal procedure. That is, for "lack or insufficient formation of evidence." The verdict was issued on June 27, 2013. During the appeal trial, a sensational environmental wiretap emerged, carried out 40 days after the kidnapping, in which, according to expert Mendolìa, Jessica Pulizzi is heard whispering to her younger sister Alice: "We were at home... mom killed Denise." But another expert appointed by the same Court of Appeal (Delfino) later stated that the sensational phrase "is partly inaudible." But even this wiretap (for the defense lawyers "nothing can be heard") was not enough to overturn the verdict.
