Denise case: appeal trial for Jessica Pulizzi, first hearing on April 18 Palermo, Feb 15 - (Adnkronos) - After the acquittal in the first instance, the second-degree trial opens for Jessica Pulizzi, the half-sister on her father's side of Denise Pipitone, who disappeared without a trace in Mazara del Vallo (Trapani) on September 1, 2004, when she was just under four years old. The first hearing before the Palermo Court of Appeal has been set for April 18. Prosecutors had requested a 15-year prison sentence for Jessica Pulizzi, but last June the Marsala Court acquitted her of the charge of complicity in the kidnapping of the child.

Reflections of a lawyer: "Denise case" ahead of the upcoming hearing on April 18 in the Court of Appeal in Palermo, I will tell you about the verdict and the reasons that led the judges of Marsala to acquit Pulizzi Jessica.
"The judgment challenged here, while acknowledging “…some probative force identifiable: A) in the motive for the crime, constituted by the feeling of resentment harbored by the defendant towards her father Pietro Pulizzi and/or Pietra Maggio; B) in the false statements made by Jessica Pulizzi to investigators – in the two days following Denise’s disappearance – when she was interviewed as a ‘person informed of the facts’; C) in the conversation recorded inside the police station during which the defendant, perhaps, revealed to her mother some phases of the crime” (see judgment p.262), nevertheless excluded the responsibility of Jessica Pulizzi because: “the accusatory construct: is characterized by strong ambiguity; is supported by a modest number of circumstantial elements, marked by not insignificant moments of implausibility; coexists with multiple alternative hypotheses.” (see judgment p. 266)
The logical-legal reasoning of the Judges of first instance in reaching such peremptory conclusions unfolds through the points recalled below. (continued in the next post)

12/03/2014 - Denise case: analysis of the judgment proposed with the civil party's appeal continues:
Time of the abduction of the minor Denise Pipitone. According to the Court: "The investigation did not make it possible to identify elements that would allow us to definitively anchor the moment of Denise's disappearance to one or the other of the periods identified." (cf. p. 36)
In this regard, the Court considers possible a hypothesis regarding the kidnapping of the minor Denise Pipitone, namely that: “Jessica Pulizzi, with a sudden and occasional decision and, in any case, without any premeditation or organization, while casually passing along Via La Bruna, saw Denise alone in the street and at that moment decided to take her (with her own scooter) and take her elsewhere. It is essentially on this last hypothetical reconstruction – from now on to be assumed as the 'unknown fact' subject to investigation – that attention must be focused, consistently with the results of other findings that have been reached. In fact, on the one hand, it appears inconsistent with the premeditation of the crime and with the approach of the moment of its commission that Jessica Pulizzi, on the morning of September 1, 2004, was engaged in daily activities (buying clothes; blood test; school enrollment), not even able to serve as 'alibis' with respect to the criminal act; on the other hand, one of the (few) circumstantial pieces of evidence acquired during the investigation is consistent only with the hypothesis of the lack of premeditation of the crime.
This refers to the conversation in which Jessica allegedly confessed to her mother that she had taken Denise together with Alice in order to bring her before her father Pietro Pulizzi who, however, at that moment was at work "(See judgment p. 49)
8. The reasons that led Jessica to harbor suspicions about her father's love life as indicated by the defendant during the examination are:
"the father of one of her classmates reported having seen Pulizzi on a country road in a car with a woman;
by chance she found herself in the clinic where Piera Maggio was hospitalized and a nurse told her that her mother had just given birth to a baby girl and that the father, Pietro Pulizzi, had gone to visit her a short time before;
He had had the opportunity to read some text messages from a woman referred to as "Cucciola";
of having been taken by her father to the herbalist's shop where Piera Maggio worked and that on that occasion, due to the familiarity shown between the two, she suspected the existence of a romantic relationship;
of having read an SMS stored in the father's memory in which the sender wrote: "Denise has a fever." (cf. pp. 62-63)
9. "In reality, what is demonstrated is not certain knowledge but rather the existence of valid grounds for suspicion... what is nevertheless significant from a probative standpoint for the reconstruction of the motive is the fact that she had repeatedly expressed her strong suspicions and substantial doubts to others." (cf. judgment pp. 64-65)
10. In relation to Anna Corona, the witnesses—all belonging to the Maggio/Pipitone family unit—reported multiple behaviors (perceived as) aggressive and threatening, which would constitute signs of the resentment and desire for revenge that motivated the woman towards Pietra Maggio. (see p. 66)
11. Episodes concerning Jessica Pulizzi, such as threatening phone calls to Pietra Maggio, stalking, insults, slashing the tires of Pietra Maggio's car, and hostile attitudes shown towards Denise; (See judgment from p. 74 to p. 78)
12. The verification of the reliability of the texts that narrated the episodes just described, all taken from the memories of Denise Pipitone's family members, essentially agree with the statements of Jessica Pulizzi and Anna Corona... nonetheless, the inconsistencies seem essentially the result of a (pre)judgment regarding the involvement of Jessica Pulizzi and her mother Anna Corona in the crime... attributing ex post to each of their behaviors—even those without meaning—a premonitory value of the action that would later be committed against Denise Pipitone. (See sentence p. 79) (continues in the next post)

Denise case: continued publication of parts of the appeal filed by Piera Maggio and parts of the acquittal sentence of Jessica Pulizzi: "It appears rather discordant, from a logical point of view, to consider, as the first Judges did, that the 'sideways' glances cast by the defendant could be 'the result of a plausible (and perhaps inevitable) "demeanor", since it cannot be expected of an adolescent... to repress a feeling of curiosity and prevent her from lingering with her gaze on someone she suspects to be her sister.”
Such behavior might appear admissible, if it were not marked by all the other unequivocal actions, criminally relevant, such as:
- telephone disturbances;
- insults on the street;
- telephone threats;
- the stalking of Piera Maggio after work;
- the repeated passages aimed at persistently observing little Denise near the residence on via D. La Bruna;
- the wheel cut;
a series of behaviors that, certainly, are characterized by a single objective: to make life impossible for Piera Maggio.
In this regard, it is inaccurate to claim that Piera Maggio did not react to Jessica's harassment, except in some episodes where the young Jessica went far beyond the limit.
In fact, Piera Maggio reported that she turned to her sister-in-law, Anna Corona, Giovanna Marino, as well as several times to Piero Pulizzi, but in any case the "demeanor" – correctly using this term, which etymologically has a positive connotation of behavior, in this grammatical context and not in the one used in the ruling, because in any case Jessica Pulizzi's behavior cannot be defined as "demeanor" – shown by Piera Maggio on all occasions provoked by Jessica was one of indifference to avoid giving rise to further and much more serious incidents, even though this served no purpose.
The rule of experience, in similar cases, confirms that many people who are subjected to harassing behaviors, even silently harassing ones, do not react or take particular precautions – for example on the street – precisely to avoid an escalation of such behaviors.
Well, the aforementioned conduct certainly does not run the risk of being suggestive, as it is detailed and characterized by behaviors unequivocally aimed at obsessing Pietra Maggio and her family members—elements which, according to now well-established experiential rules, define the so-called "unhealthy" relationships arising from unresolved separations.
The judgment reads: Here too, always with the aim of removing the risk of falling into misleading suggestions regarding the "intensity" and "exceptionality" of such feelings, it must be emphasized the radical and evident heterogeneity—on the competing levels of gravity and the legal interests harmed (the wheels of a car; the freedom/life of a child)—between the criminal act confessed by the defendant and the one under investigation in this proceeding. From this perspective, there is such a disproportion between the two episodes that it is not permissible to draw from the first a reliable indication of that criminal capacity and that emotional power which would inevitably constitute the psychological substrate for the realization of the other.

Therefore, according to the first Judges, it is not permitted to draw from those actions "a reliable indication of that criminal capacity" suitable for committing the much more serious crime of Denise's abduction.
It cannot go unnoticed that there is a short-sighted reasoning to the extent that, in this regard, the rules of experience come to the rescue, which, from 2004 to today, have led the Legislator to reassess these "anomalous behaviors," apparently harmless, which in most cases have resulted in the murder of a partner and in extremely alarming crimes (entire families exterminated by neighbors), typifying such conduct with a specific offense such as, for example, Article 612 bis of the Penal Code, further aggravated recently with an amendment introduced with the so-called security package of August 2013.
All this appears essential to frame, in the correct perspective and within the context of obsessive persecution, the numerous and detailed list of actions and behaviors that the trial has presented to us.
The judges labeled Anna Corona's conduct as "criminally insignificant," downplaying her multiple actions, essentially, to the disclosure of a secret. (continues)

Mazara del Vallo: The memory of Denise Pipitone forgotten in the “Villa al mare”
The memory of Denise Pipitone forgotten in the "Villa by the sea"
It certainly makes a strong impression and makes you think, that sign almost on the ground standing in front of that little, very neglected tree, dedicated to little Denise Pipitone who disappeared on September 1, 2004 in front of her home on via
Domenico La Bruna. The scene of the devastation is Villa Jolanda, one of the two villas in the city.
That little tree and the sign wishing Denise Pipitone a happy birthday were planted in 2006 on the occasion of the little girl's sixth birthday, a tribute wanted by her schoolmates.
The incivility of some people over the years has had its effects, so much so that Piera Maggio herself, Denise's mother, declared on one occasion: "the city does not forget Denise, even if some actions make me think a lot, like a stone star, given to me and placed on the little tree dedicated to Denise, at Villa Jolanda, but stolen after a few days." Well dear Piera Maggio, we do not agree, perhaps it would be better to say, and we do so with much sadness and even anger, that the City remembers Denise Pipitone only on September 1st each year, to remember her disappearance, and only on October 26th, to remember her birthday.
How evident it is in the municipal villa is an excellent indicator of the attention paid to the case, never solved, of little Denise. Certainly, the vandals should be condemned—perhaps the same ones who broke some ceramic vases, motivated, as the mayor pointed out, by political reasons—but no one has noticed the condition of that sign (see photo), now rusted (we assure you this time it's not the sirocco's fault, which has left us in peace for days), and of the little tree? We have noticed that the same conditions have persisted for months.Yet almost every morning a team of municipal workers seems busy cleaning and pruning the plants of the same villa, which a few years ago Mayor Cristaldi called the "villa by the sea" because it is right in front of the "beach in the city".
Is it possible that no one noticed this outrage and ignoble act, is it possible that no one (even among the many attentive people on Facebook who relate comments, etc.) reported the incident to the mayor? In short, the same carelessness shown when some spray-painted writings appeared on the front part of the nearby Norman Arch; even then the authorities learned about it through the press. "We have always noticed this over the years and it hurt us so much that we decided to pretend that this place dedicated to Denise did not exist." This is what Piera Maggio and Piero Pulizzi (both in the photo), mother and father of little Denise Pipitone, stated,
following our publication last March 21 of an article regarding the poor condition of the sign and the little tree, at the very central Villa Jolanda, dedicated to the little girl who disappeared on September 1, 2004, in front of her home on Via Domenico La Bruna.
The little tree and the sign wishing Denise Pipitone a happy birthday were planted on October 26, 2006, on the occasion of the little girl's sixth birthday, a remembrance desired by her schoolmates. For months, the flowerbed that should commemorate the disappearance of little Denise Pipitone has been in a state of evident neglect.
Several years ago, unknown individuals stole a stone star that had been donated and placed near the same little tree in Villa Jolanda. It is unclear why none of the various municipal workers who are engaged daily in cleaning the same municipal villa noticed the poor condition of that sign, now rusted, and of the little tree (photo 2).
Thus Piera Maggio and Piero Pulizzi declared: "We have deliberately stopped talking about this place; believe us, it hurt us so much to see the neglect and carelessness of that spot. Just imagine, a couple of months ago the tree was being strangled by a wire that was once stuck in the ground. If, in memory of Denise, for the institutions it is only September 1st when she disappeared, and October 26th, her birthday, but actions were also taken, it would be even better and commendable. In any case – they concluded – Denise should not only be remembered, but the proper attention should be paid to a missing child, not a dead one." The appeal trial related to the case of her alleged kidnapping will begin on April 18 in Palermo.

Well, the aforementioned conduct certainly does not run the risk of being suggestive, as it is detailed and characterized by behaviors unequivocally aimed at obsessing Pietra Maggio and her family members, elements which, according to now well-established experiential rules, define the so-called "unhealthy" relationships arising from unresolved separations.
The judgment reads: Also here, always with the aim of removing the risk of falling into misleading suggestions regarding the "intensity" and "exceptionality" of such feelings, it must be emphasized the radical and evident heterogeneity—on the competing levels of gravity and the legal interests harmed (the wheels of a car; the freedom/life of a child)—between the criminal act confessed by the defendant and the one under investigation in this proceeding. From this perspective, there is such a disproportion between the two episodes that it is not permissible to draw from the first a reliable indication of that criminal capacity and that emotional power which would inevitably constitute the psychic substrate for the realization of the other.

Therefore, according to the first Judges, it is not permissible to draw from those behaviors "a reliable indication of that criminal capacity" suitable to commit the much more serious crime of Denise's abduction.
It cannot go unnoticed that this is a short-sighted reasoning, insofar as the rules of experience come to our aid, which, from 2004 to today, have led the Legislator to reassess these "anomalous behaviors," apparently harmless, which in most cases have resulted in the murder of a partner and extremely alarming crimes (entire families exterminated by neighbors), typifying such conduct with a specific offense such as Article 612 bis of the Criminal Code, further aggravated recently with an amendment introduced with the so-called security package of August 2013.
All this appears essential to properly frame, within the correct perspective and within the context of obsessive persecution, the numerous and detailed list of actions and behaviors that the trial has presented to us.
The Judges labeled Anna Corona's conduct as "criminally insignificant," downplaying her multiple behaviors, essentially in the disclosure of a secret. (continues)

April 2, 2014 - Denise Case: continuation of the publication of the appeal filed by Piera Maggio: "To support these assessments, the First Judge uncritically relies on the statements of Pulizzi Jessica and on the confirmation given by her sister Alice, going so far as to state that 'the daily normality' described by Pulizzi - but not otherwise confirmed, adds the undersigned, - 'appears incongruous with the premeditation of the crime and with the approach of the moment of its execution. The fact that Jessica Pulizzi on the morning of September 1, 2004, was engaged in daily activities (purchasing clothes; blood test; school enrollment), is not even sufficient to serve as an "alibi" with respect to the criminal act' (see judgment p. 49).
With this statement, the first Judges confirm that Jessica Pulizzi's defensive intent was achieved, since it is precisely this "normal" daily routine of chores which, although according to the Judges is not suitable to provide an alibi, on the other hand, allows her innocence to be demonstrated, precisely because the normal sequence of meetings and handling of domestic affairs is hardly compatible with the serious event she is accused of having committed that morning.
Nevertheless, it could have its own valid reason for being if the facts narrated by the defendant were objectively confirmed by the testimonies of the various witnesses; otherwise, the account she gives of that morning must be considered false.
First of all, it should be noted that Jessica Pulizzi was questioned on September 2 and 3, 2004, giving a completely false version, but according to the Judges of the Court this was due to her young age, 17 years old, and the "immaturity of the behavior shown by Pulizzi (as emerges from the conversations intercepted inside the police station) in dealing with the seriousness of the crime and the risks of her involvement in the investigation."
It is truly difficult to understand the logical reasoning of the Judges, which goes against the millennia-old rules of experience in evaluating reticent and mendacious statements made immediately by people informed of the facts, whose position soon after worsens.
Furthermore, it is not taken into account that, being a minor at the time, a close relative was present on the two occasions when she was questioned. In fact, on September 2 the maternal grandmother was present, and on September 3 Anna Corona, who was also questioned on the same occasion, so this should have led her to make her daughter reflect on what she had actually done on September 1.
Moreover, if Jessica Pulizzi is immature to grasp the value of her false statement in relation to the seriousness of the crime and the related risks of her involvement, it appears contradictory that the Judges state, when referring to the motive, that there is a disproportion between the exceptional nature of the event and the actions that she herself had previously taken against Piera Maggio.
The two motivational points in strong contradiction are juxtaposed:

The motivational contradiction appears in all its amplified evidence, because if, on the one hand, the defendant is considered by the Judges to be immature in grasping the seriousness of the false statements and in confronting, in this sense, the crime, then, even more so, on the other hand, she is immature to the point of not grasping the seriousness of the act she committed. Therefore, it is possible to draw from the conduct carried out before the abduction of little Denise a clear indication of that criminal capacity, which is precisely detectable in immaturity.

Well then, the false statements made during the first two days undermine from the outset the credibility of Jessica Pulizzi, regardless of the assessment of the defendant’s immaturity which, in any case, if taken into consideration, must be evaluated by applying it as a parameter of measurement at every moment of her behavior.
Nor can “immaturity” influence the defendant’s conduct positively, becoming a justification for it.
At this point, it must be done one step at a time and, it should be specified that Anna Corona was questioned by the Carabinieri on September 1, 2004 and on September 3, 2004 by the Public Prosecutors and the Captain of the Carabinieri at the Mazara del Vallo Station.
The daughter Jessica Pulizzi was questioned on September 2, 2004 by officers of the Police Station and on September 3, 2004 by the Public Prosecutors and the Carabinieri Captain at the Mazara del Vallo station.
Therefore, according to the rules of experience and, considering the particular relationship between mother and daughter, if the minor Jessica, questioned by two magistrates and several Carabinieri, does not grasp, due to her immaturity, the meaning of what is happening to her, it nevertheless cannot be considered likely that the two women, questioned repeatedly in the days immediately following, did not communicate to each other what they had reported to the investigators.
Well then, although Anna Corona was, at the same time, Jessica at the Carabinieri station to be questioned by the investigators, she says nothing about September 1st regarding what her daughter did, nor does it seem plausible that her daughter did not speak with her mother about what she told the investigators." Denise case: here is what the Judges write about the intervention of the police at the Corona house at 3:30 pm on September 1, 2004: "Instead, in a manner completely contrary to the correct application of the verification criteria, they state: 'No evidentiary value can be attributed to the vague recollections on the matter by the police officers: in this regard, it seems implausible that the witnesses, after eight years and without having developed any uncertainty about the ownership of the apartment, would have retained the memory of such a marginal (and apparently) insignificant gesture, especially when considering the context of an extremely patchy and often mutually contradictory recollection'" (see judgment p.207)
Well then, the fragmentation of the circumstantial assessment on this point is fully evident, as there can be no doubt that it was the Crown who let them into that residence, having confirmed it in court and this fact having been corroborated by qualified witnesses such as the very officers who personally experienced the event.
The first Judges, at this point after analyzing the statements of the officers and the neighbors of Corona, namely, Giacoma Pisciotta and her daughter Emanuela Di Giorgi, continue the logical and motivational development by outlining the case as follows: “At this point it is necessary to dwell, in order to evaluate the evidentiary findings regarding the alleged 'deception' carried out by Anna Corona, on three significant aspects addressed by the P.G. witnesses:”
- the reasons for the meeting with the Crown …..
-on the subject who made the proposal to continue the conversation inside the ground floor dwelling….
-on the reconnaissance activity carried out inside that apartment, which if conducted (moreover with the consent of the Crown) would assume decisive evidentiary value as well as of the erroneous belief in which the law enforcement officers found themselves regarding the ownership of the residence and also of the deceptions carried out by the Crown.
Regarding the first aspect, Tumbiolo, Accomando, and Di Girolamo reported that they went to the Corona's house to search for the missing girl. (cf. Judgment p. 205).
Starting from the first of the questions posed by the Judges on "the reasons for the meeting with Corona," the Court considers that the chronology of events leads to the opposite conclusion: that the law enforcement officers went to Anna Corona's house to look for Piero Pulizzi. In fact, they had first gone to his residence in Via Valdemone without finding him, so they came to the conclusion that: "From this perspective, the explanation offered by the other people present at the meeting appears more consistent, as they essentially stated that they understood that the visit was part of the search (not for Denise but for) Pietro Pulizzi. (See judgment p. 207)"
This passage of the sentence is characterized by a particularly short-sighted pedantry regarding the reasons that led those police officers to Anna Corona's house.
In fact, no contribution can be offered by the people present, namely (Anna Corona, Jessica Pulizzi, Giacoma Pisciotta, and Emanuela Di Giorgi), since the officers, in carrying out their duties, maintain, precisely for reasons of investigative secrecy, a certain rigor in explaining the reasons for their intervention. This is taught by experience, so inferring the true motivations for their intervention from the statements of those who were the subject of their check appears illogical as well as misleading.
We must not lose sight of the central point of the matter, namely that the officers learn at Piera Maggio's house about Denise's true paternity, so they go to Pulizzi's house to look for the child and, not finding her, they go to Anna Corona's house, but the object of the search is always the child.
So much so that they also indicate it in the service report drawn up at the same time as the events.
In that report drafted on September 2, reference is made to the activity carried out by them on September 1, in the afternoon, and all the witnesses report what was noted, namely that they went to Anna Corona's house after not finding Pulizzi at his own home, and "that Corona let them into the house, allowing them to verify that the minor who was the subject of the search was not present inside." April 4, 2014 - Denise Case: final assessments by the Judges on the intervention of law enforcement at Anna Corona's house: "Now, the glaring contradiction in which the Court stumbles is taken to the extreme in its conclusions where it states, among other things, that: '...it seems much more plausible that the (uncertain and partial) memories of Di Girolamo (and the other law enforcement officers) were deeply influenced by inductive experiments, all based on the (false) premises that (also) at that time they were engaged in searching for the child. In fact, it seems much more likely, for the reasons already indicated, that they were actually looking for Pietro Pulizzi, the child's "hidden" father, and that the conflicts between Anna Corona and Pietra Maggio had not yet even emerged.'
For the reasons set out, the circumstance under analysis must be considered radically uncertain in its occurrence, and therefore must be completely excluded from the overall evidentiary reasoning” (Cf. judgment pp. 208-209) (ID EST!)
Therefore, according to the first Judges, these are “memories conditioned by inductive experiments, all based on (false) premises”; this judgment could be based on its own logical reason if there were no ascertainment, indicated in the descriptive annotation of the activity of September 1st carried out at Anna Corona's house, as per the urgent survey of the places and things, having a descriptive function of facts and situations, carried out urgently, before the Public Prosecutor took over the direction of the investigations.
But if, in addition to the urgent investigation, there are also, after 8 years, the testimonies of the Judicial Police Officers from both the Carabinieri and Police forces who participated in the unrepeatable activity, the "unreliability of evidentiary data" asserted by the First Judges appears in all its incomprehensible error in law and in fact. Meanwhile, on Friday the 18th, the trial against Pulizzi Jessica and Gaspare Ghaleb begins at the Court of Appeal in Palermo.
Denise case: I am posting the motivation of the Marsala Judges regarding Jessica's phrase "quannu eru cu Alice a pigghiai e a casa c'ha purtà": The Court states: “…Jessica, when she asks her mother about Denise's resemblance to her father (and to herself), lowers her voice (for fear of being overheard or intercepted) and reveals for the first time that “when I was with Alice I took (editor's note: the child) and brought her home (editor's note: to dad).
At that point Anna Corona, after not even a second, became aware of the seriousness of the situation and, believing she might be intercepted (thus realizing she had to hide the inevitable emotions connected to the confession), without changing the tone of her voice, repeats the question she had just asked before the revelation, answering and asking again: “Well, I tell you, do you have problems with God?”.
After two or three tenths of a second, Jessica, having understood what her mother is implicitly suggesting (that is, to "pull herself together" and continue pretending), raises her voice again and, changing the subject, states: "no però già lu dissi io quannu …era" (See judgment p. 155)
The hypothesis just adopted by the Board is based on two elements, the first concerning the topic discussed by the two women regarding the resemblance between Denise -Jessica-Pietro Pulizzi.
This topic also allows the sentence to convey the implied meaning regarding the place where the girl would have been taken, that is, to the home of her father Pietro Pulizzi.
The second element that, according to the Court, supports this interpretation is "the low tone with which Jessica pronounces the phrase, which constitutes a sign of the intention not to allow it to be perceived externally. From this perspective, it is a logical rule that the intention to hide something reveals the existence of something to be concealed. In this case, since the topic previously discussed is the 'resemblance of Denise' and since the different contexts of the conversation (the police station; the investigators' suspicions; the mother's questions) all refer to a little girl who was 'taken and brought elsewhere,' the act of concealment could concern precisely a little girl who was 'taken and brought to the father.'
However, despite the logical argumentative development proposed by the board, the hypothesis appears according to the Judges to be “not even probable or highly probable” (see judgment p. 156)
Finally, the last hypothesis considered by the Judges is that even the omission of a single word may decisively affect the meaning of a sentence.
In this view, the expressions used by Jessica in that conversation, characterized by a provocative context in which the two interlocutors moved, it is possible that: "the device failed to record an expression revealing the reference that Jessica made to the investigators' words, thereby offering an explicit meaning of that sentence radically different from the authentic one (editor's note: they keep repeating to me that / how can they believe that / they say that the witnesses saw me / he says that / he says: when I was with Alice I took and brought it to her at home) (see judgment 163-164)
Well then, the forced approach that the Judges of the Court have taken in their reasoning, strongly characterized by the self-referential nature of the suspect's statements or by the corroboration these have with her sister and with her mother Anna Corona, leads to a distorted interpretation of all the circumstantial elements which, on the contrary, are marked by a clear and precise evidentiary value against Jessica Pulizzi.
What is relevant in this case, regarding the sentence: “quannu eru cu Alice a pigghiai e a casa c’ha purta’ ”, is that all the Experts called to listen to and transcribe the sentence, as well as the party consultants, including those of the defendant, did not contest the sentence, which therefore was certainly uttered by the defendant.
The last hypothesis expressed by the Court is categorically excluded, namely that Jessica was referring to something that had been reproached or said to her by the investigators at another time during the day at the police station.
On this erroneous interpretation, the Court devotes as many as 2 and a half pages in its reasoning, from page 161 to page 163, in which it lists “all the sentences in which Jessica referred to what she was told at that time”.
An honestly garantist effort, truly commendable on the part of the Judges, but certainly useless, because:
1. not compatible with the particularly sensitive arguments addressed in the portion of conversation subject to the incriminated sentence (the resemblance to Denise and not, also, as in the other parts, the accusations made against her);
2. not compatible with the lowering of the tone of voice (in fact, in the other portions reported in the judgment there is no lowering of the tone), indeed, strictly speaking, it would have been appropriate for Pulizzi to raise her tone to protest the unjust accusation;
3. inconsistent with the mother's reaction who, just as she did throughout the time she was at the police station, should have been outraged by such a defamatory accusation (on the contrary, she has a restrained reaction aimed at stopping her daughter from repeating the phrase (well, whatever!!));
4. The conduct of the defendant and the reaction of the mother are absolutely inconsistent with other parts of the conversation in which, on the contrary, the two women refer to facts and situations that were being attributed to them by the investigators.
5. Finally, both women, when heard in court, never gave this explanation of the phrase; on the contrary, they denied having heard it, so it seems highly unusual that if the phrase had been expressed in reference to the unjust accusation of having taken the child made against them by the investigators, in all these years (first during the investigation and then during the trial) they would have remembered it in some way.

The Palermo General Prosecutor's Office and the Trapani Prosecutor's Office appealed the first-degree sentence after reading the motivations, we believe that many aspects exclude many elements that, in our opinion, must instead be part of the body of evidence." This was stated to Adnkronos by lawyer Giacomo Frazzitta, legal representative of Piera Maggio, who adds: "We are not looking for a culprit but the culprit. We are certain of what the key to the matter is, it is clear that we are waiting for confirmation from justice. The lawyer will ask the Court of Appeal, presided over by Raimondo Loforti, to acquire the judicial police report drawn up on September 2, 2004, by the Mazara del Vallo police station, "as it is an unrepeatable act." This concerns the search of the home of Anna Corona's neighbor, mother of Jessica Pulizzi, as claimed by Piera Maggio's defense.
Furthermore, the examination of the witness Battista Della Chiave will be requested, the deaf witness who in the first instance had exercised the right not to answer. Finally, a "new expert analysis on the portion of the recording between Gaspare Ghaleb and Jessica Pulizzi of the tape recording will be requested, in consideration of the fact that the defendant, intercepted in another recording, claims to have uttered the word 'Picciridda' while speaking with Ghaleb."
Palermo, Apr 18 - (Adnkronos) - Audio and video recordings are allowed at the appeal trial for the disappearance of little Denise Pipitone, the four-year-old girl from Mazara del Vallo who went missing ten years ago. The lawyer for the defendant Jessica Pulizzi, Gioacchino Sbacchi, had expressed opposition at the start of the hearing because, in his opinion, the Rai 3 program 'Chi l'ha visto' has a "prejudice" against Denise's half-sister, who is accused of child abduction.
